Hello everyone, I'm Mary Celone Welcome to today's Tuesday tip. This week, based on some questions we received in the last month or so, we're going to be doing a little compliance review of HUD's updated VAWA forms. In 2025, HUD issued updates to the Violence Against Women Act or VAWA documents. And this actually included the introduction of one new form as well. HUD later issued further notice that discussed how the documents required owner agents to customize certain areas of the forms based on their specific programs and information. And it also stated that this customization was required to be completed in the updated documents by owner agents by June of this year. The revised VAWA forms now have the expiration date of January 31st, 2028. So you want to be sure that these are the versions of the forms that you're now using. You also want to be sure that you are using completed forms. This is always the case for any HUD form, of course. Any data that you require to fill in on a document always must be completed before you're using it. But these updated VAWA forms especially have some new areas where customization is required for your program and your property. The first form is the HUD 5380 Notice of Occupancy Rights. This is the form that details the VAWA housing protections for tenants and applicants. And the updated version of this form requires you to customize details about emergency transfer requests and transfer plans, requesting reasonable accommodations, language accessibility, and how to contact local advocacy, legal aid, and the local HUD FHEO field office. Next is the Form 5381 Model Emergency Transfer Plan. This is actually a template model for a properties plan for emergency transfers under VAWA. Now, it's a requirement to have an emergency transfer plan for VAWAT. This is a model from HUD that can act as a guide for creating that. There are many specifics, obviously, you would need to customize with this document. And HUD actually for that purpose includes drafting notes in the document to assist. Just remember to delete those from your final plan once you're done if you use this form. The third form is the HUD 5382 certification. Applicants and tenants can use this form for written documentation of victim status when requesting protections under VAWA. And here in the updated form, you'll need to customize information on language access requests and contact information for local advocacy groups and legal aid. And the fourth current but updated form is the HUD 5383, Emergency Transfer Request Form, which can be used by tenants in requesting emergency transfers under BAWA. And like the 5382 certification form, it requires your details about language access, local advocacy groups, and legal aid organizations. The final form of the bunch is the new addition, the HUD 5384 form, VAWA Emergency Transfer Data Collection Form. This form is for owner agents to use in their record keeping of emergency transfer requests made under VAWA and their outcomes. Owner agents are required to keep records of this information. So this form is to help with that purpose. It's important to remember that both the HUD 5380 and 5382 VAWA forms still need to be provided. And they have to be provided when to applicants when they're being denied assistance or admission. They need to be provided to tenants upon move-in or initial certification when adding assistance, and with any notification of eviction or a termination of assistance. And you also want to be sure that you're updating these forms with your existing residents who received copies of the now outdated forms instead.
