Unpublished HUD Notice Extends AFFH Comment Deadline to May 9

Posted On: May 5, 2025

Update ( May 7, 2025): HUD published the document on the AFFH comment deadline. You can view it here.

HUD has extended the AFFH comment deadline. While the U.S. Department of Housing and Urban Development has not officially published the announcement in the Federal Register, the document is available for public inspection. If you missed the initial window, you now have until May 9, 2025, to weigh in.

What You Need to Know About the Unpublished HUD Document

On May 2, HUD filed a notice with the Office of the Federal Register (OFR) extending the public comment period for its interim final rule on Affirmatively Furthering Fair Housing (AFFH). HUD originally published the rule on March 3, 2025, with comments due by May 2.

Due to technical issues on Regulations.gov that disrupted electronic submissions around April 28, HUD extended the deadline by seven days.

The new AFFH comment deadline is May 9, 2025.

You can view the document here.

This document is currently unpublished. It has been filed for public inspection, which means the public can access it now—but it has not yet been printed in its official form.

What Does ‘Public Inspection’ Mean?

FederalRegister.gov maintains a Public Inspection list that provides early access to upcoming government documents. Here’s what that means:

  • Not Official Yet: This document version does not carry legal or judicial notice.
  • Scheduled Publication: Expect the official version of this HUD notice to publish on May 7, 2025.
  • Downloadable Now: You can download the unpublished PDF version here.
  • For Legal Research: If you’re referencing this document for legal or regulatory purposes, verify its contents against the official edition when it’s published.
  • Learn more about the public inspection process here.

What the Final Published Document Will Include

The upcoming official publication is expected to confirm:

  • An updated comment deadline of May 9, 2025
  • Explanation of technical issues that prompted the extension
  • Instructions for submitting comments by mail or online
  • Contact information for HUD officials

Importantly, the content of the interim final AFFH rule itself remains unchanged—this update is purely about giving the public more time to respond.
